Seven bills, including revising salaries of elected members and redevelopment of dilapidated buildings, have been passed by the Gujarat assembly on Wednesday. The other bills that have been passed are the formation of a commissionerate for municipalities, the amendment in IPC for a strict law against chain snatching cases, approving the revision in GST tax rates, formation of biotechnology university and penalties against unrecognised schools and examination paper leak cases.
The process of redeveloping dilapidated structures, especially those of the housing colony, has been simplified. The required consent from housing unit owners will be made 75% of the total owners against present provision of 100% in case of redevelopment now. The bill suggested amendment in the Gujarat Ownership Flat Act, 1973. The bill said that redevelopment or reconstruction of old buildings is not possible sometimes as the occupants don't give consent. It is therefore contemplated to remove such provisions and replace it with the provision for redevelopment or reconstruction should be made after consent received from not less than 75% of total occupants.
The government has said the clause in the act that buildings to be redeveloped or reconstruction should be 25 or more years or else the tenure of 25 or more years should have been completed after the development permission given by competent authority. The competent authority shall have to certify the building as dilapidated or decayed which could be harmful for its occupants, residents or users, buildings or properties nearby that building or the passers-by.
The bill making the laws against chain snatching more stringent was also passed by the Gujarat House. The bill making amendment in the Article 379(B) and (B) of Indian Penal Code(IPC) in which the sentence will be five to ten years imprisonment and Rs. 25,000 fine against the crime of chain snatching and death in the attempt.
Another bill about the formation of a new commissionerate for the municipality and replacing the old system of a directorate of municipalities was also was tabled during the session. The government has already made the appointments of a commissioner and subordinate officials and staff in the authority and the bill aimed at giving legal entity and more powers to authority.
The GST Act amendment bill was also passed by the House as per change in slabs of the taxes decided by the GST Council.
However, two bills that proceeded in absence of the opposition after their walkout in the second sitting on the issue of no trust motion against the government.
The Gujarat Secondary and higher secondary Education Act (Amendment) bill was also passed unopposed. The bill is aimed at punishing schools operating across the state without recognition of any board and persons involved in cases of exam papers leak. The schools running without recognition will have to pay fine of up to Rs 2 lakh in place of Rs 1000. While the persons found guilty in case of the paper leak will have to face imprisonment of up to 2 years and Rs. 200 fine. The bill forming biotechnology university also pass through the house.
